The Optik Direct site is owned by Optik Online Limited (‘Optik’)

All Customers using this site acknowledge to have read these terms and conditions and understand them, and agree to be bound by all of them. Optik reserves the right to vary these terms and conditions from time to time entirely at its discretion. The use of this site by customers is subject to the most recent terms and conditions posted from time to time.

Optik reserves the right entirely at its discretion to decline to supply to any Customer not complying with these terms and conditions.

All Customers ordering contact lenses on the site must have a valid and current prescription. The details entered on the site must exactly match the prescription given to the customer by their eye care professional.By placing an order on the site the Customer gives permission for Optik to contact the Customer’s eyecare professional to confirm the prescription details.

Customers must only order contact lenses that they are wearing successfully. They must follow the wearing and care regimes given to them by their eye care professional and must stop wearing the prescribed contact lenses if directed to do so. Optik takes no responsibility for any Customer’s lack of suitability to wear contact lenses.

The Customer agrees to seek assistance from their eye care professional and stop contact lens wearing if the Customer experiences ocular redness, discomfort or unexplained burred vision.

Optik reserves the right to cancel any contact lens order if the order details do not match the eye care professionals confirmed prescription for the Customer.

Payment for orders placed on this site shall be in New Zealand dollars and shall be made by Visa and Mastercard credit card only. By placing an order on this site, the Customer accepts that the Customer is the person responsible for the credit card used when placing the order and is thus responsible for any charges made using this credit card on the site.

All charges made by Optik on this site are inclusive of New Zealand Goods and Services Tax.

Delivery of contact lenses and solutions ordered on this site is free within New Zealand. Optik reserves the right to charge postage for overseas orders.

Refund Policy

Unopened boxes of contact lenses purchased on this site can be refunded if returned to Optik in undamaged condition within 30 days of purchase.

Linked Sites

As a convenience, Optik may link to other sites that may be of interest to the Customer but are not under the control of Optik. These links do not imply endorsement by Optik and Optik is not responsible for the availability of, or the content contained in, any linked site. The Customer agrees that by accessing any linked site the Customer does so at his or her own risk and agrees to fully indemnify Optik against any liability arising out of the accessing of any linked site.

Privacy

Customer privacy is important to Optik. Optik will not breach the requirements of New Zealand’s Privacy Act 1993, and in accordance with that Act wishes to draw the Customer’s attention to the following matters:
(a) Optik may collect, retain and use information about the Customer in order to administer its business.
(b) Optik will not sell, publish or give away the Customer’s information without the Customer’s consent.
(c) The Customer has the right to access his or her personal information held by Optik.
(d) The Customer has the right to correct personal information held by Optik if it is incorrect. The customer should contact Optik at sales@optikdirect.co.nz to access or correct personal information held by Optik.
(e) Optik may, at its discretion, charge to the Customer any reasonable costs incurred in responding to requests for access an/or correction of information.

Indemnification

To the maximum extent permitted in law, the Customer agrees to indemnify, defend, and hold harmless Optik and its Directors against all claims, liability, damages, costs and expenses, including legal fees and expenses, arising out of or related to any claim by the Customer or any third party related to any services provided by Optik

Disclaimers

Lens Warranty Policy

All products sold on this site are covered by their standard manufacturers warranty. Any defective lenses should be returned for assessment, and if found to be faulty will be replaced at no charge.

Optik makes no warranty, express or implies beyond the manufactures warranty regarding any products sold including any implied warranties of merchantability or fitness for a particular purpose.

Choice Of Law

Any dispute arising from these terms and conditions shall be governed by and construed in accordance with the laws of New Zealand, and no proceedings in connection with these terms and conditions shall be taken in a court other than a count of New Zealand.

No Waiver/Severability

No action of Optik, other than an express written Waiver or Amendment, may be construed as a waiver or amendment of these terms and conditions.

Should any clause of these terms and conditions be found to be unenforceable, wherever possible this will not affect any other clause each of which will remain in full force and effect.

If any provisions are deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable and in such manner as comes closest as is possible to the intentions of these terms and conditions.

Miscellaneous

All rights not specifically granted under these terms and conditions are reserved to Optik.

This document constitutes the entire terms and conditions between the Customer and Optik with respect to the subject matter and merges all prior and contemporaneous communications.
